My company LDM CONSTRUCTION provided NEW 3,539 SQ.FT. "WARM SHELL" BUILDING WITH 3 UNITS - NEW 290 SQ.FT. REFUSE AREA - NEW ACCESSIBLE RAMP FROM BARROW ST. - NEW ACCESSIBLE PARKING - NEW MONUMENT SIGN - NEW PARKING LOT LIGHTS - REPLACE CURB CUTS WITH SIDEWALKS . The completion was delayed from 2/28/20 until 6/15/2021 due to PG&E Delay. The Owner losts about $12,000 of rent due to this delay. The owner still owes LDM CONSTRUCTION $75,000. Precast panels are being installed without owners approval, they are also damaged. A mockup of the Precast Panels are also required by the contract specifications for review as per specification section Exterior Stone Cladding 044200.F.1. Mockups are also required prior to starting corresponding work, fabrication or construction as per Quality Requirements 041000.K.L. Installation of the precast panels continue and the CM team has not received a date of when the mockup will be ready for review. This construction activity is not in compliance with the contract specifications and is at the full risk of Forrester Construction. Contractor proceed to do the installation without the Mockups. The Court told them to provide the Mockups and remove all damaged panels. He is claiming that will fix them after the job is finished. ...Read More

The lender has done research and found a lien on my title from the Geology company ("Action Geotechnical Consultants"). I have never heard of this company and the lender has provided only a name for me at this time, no contact info. I could not pay them even if I wanted to. A water mitigation company that does work NOT requiring contractor license, sent CA Preliminary Notice stating they provided materials n labor for "building, structure or other work of improvement" in the amount of $40000. All they did was suck up water n leave drying machines. Can I hold them to it n claim they didn't use Home Improvement Contract? They are sticking me with inflated invoice and threatening to lien. We have paid $220,000 and still have $67,000 to go. The GC did not provide us the DISCLOSURE STATEMENT REQUIRED FOR RESIDENTIAL CONSTRUCTION CONTRACT. We did not know about Statutory Retainage and thus have not been withholding. How do I make up for this? I thought lien waivers up to this point from all subs and we would withhold 10% from this point forward. Or if will not provide lien waivers (pretty sure he will not) can we do 50% on the next 3 draws and 10% on each draw following... this would end with 10% of the contract price being retainage by the end of the build....Read More
