What are the rules in Washington State when you send a preliminary notice to GC and owner late?
A Washington Notice to Owner is generally required to be served on the owner and the GC within 60 days of the claimants first date of furnishing labor/materials to the project; or in the case of single-family residential projects, 10 days.
A late notice is still effective to secure some lien rights however. Under Wash. Rev. Code §60.04.031 these notices may be sent at any time, but they will only relate back (i.e. cover the value of labor/materials provided) 60/10 days prior to when the notice is served, and everything thereafter.
