We received a called from the general contractor attorney trying to get settled for a lesser amount and keep our right to pursuit the subcontractor who hired us for the rest of the amount owed to us. our firm has a contract with a quasi-governmental entity a housing authority, the contract was signed by the parties, and 1 provision states "upon the executed contract the housing authority shall pay the previously agreed to mobilization "the authority now refutes this and requires permits to be obtained first. , secondly, the vihfa [govermental agency] adhesion contract states "the contractor will provide a work plan for the purpose of obtaining a demo plan "however now is demanding a work plan that FAR exceeds what is required to obtain a demo permit , and if we do not produce such a work plan they will terminate our contract .my question is 2 fold what can we site to enforce their contract terms specifically "upon the execution of the contract which occurred 2 months ago ? the second issue is what can we site that an owner's drafted contract specifies the purpose of submitting our" work plan" and demanding far-reaching additional items be addressed that are expensive such as a spill boom and etc be on the job , providing geophysical analysis no the fill , where the IFB and contract requires only clean fill !! We hired someone off Craig's list to encapsulate crawl space. New construction. $2800. After the 1st few days of work we paid 2 of his employees $700 for labor and they came back the next day to complete the job. However the work was so sloppy. He agreed and said he would fix it. After 3 attempts the job is still not acceptable. We have had the county inspector and another company to look at it. It doesnt meet nc code requirments and will not pass inspection. Will have to hire a new company to come and clean up this man's mess. We still offered to pay $600 in materials. He said no. He claims now he has over $1300 in materials(including 4500sq ft of plastic only need 2100 sq ft, $200 for 18 screws etc). We asked him for receipts and he won't provide them. He is sending my husband nasty text and emails. No professionalism. After some investigating we find that he recently changed the name of his company and has multiple complaints for crappy work, getting paid and not finishing and over charging for materials. My husband said we can go to small claims court and let them decide. Instead he is now threatening to file a lien against our home. It looks like in NC anyone can just go and take out a lien and only have to give a description of the incident and show no proof. How do we protect our self from him? Please help. I signed a contract for 1,300. With a brick contractor to tuck point 4 sides of brick rails on the front of my home. He covered the 100 year old face brick with excessive mortar destroying the face of my home. I stopped payment on his check. I have no confidence he can correct this without causing more damage, and prefer to secure another contractor. He threatened a lien on my home. What recourse do I have? I know his phone number, first and last name, and have an email address for the supposed company. I cannot find that company anywhere online, but I do see a different company name associated with the gneral contractor. We hired a Design and Build company to create architect plans and 3D renderings for a closet and ADU addition. We were to move forward with the permit process and construction but due to COVID and new circumstances, we have been faced with delays and money loss in investments and change in life circumstance and now will not move forward with any work done/construction. I have a contractor renovating the exterior of my 1920's home. After the siding was replaced (original contracted work) we decided we would like to go ahead and replace the outer trim on the windows as well. The contractor provided a change order (#1), we agreed on price, and we both signed. I paid the required payment (50% up front) and the work began that day. We looked at the windows with the sub-contractor and GC at that time and discussed that we would need to add underlayment OSB in order for the trim to be level with the siding. The work began and one of the workers got very sick and had to go home. Since the project was already way over time and I have previous construction experience, I jumped in to help with demo of the old window trim and to act as another set of hands for the subcontractor and keep on schedule. When the work was complete, the GC brought me a new Change Order (#2) to sign and pay for an extra $3000 of labor on the window trim when the original signed change order was $1750, bringing the total amount to $4750 + 20% overhead. We never agreed to pay more or add any scope of work to the work in change order #1. He said he was charging extra for demo of the window trim (which I did), adding OSB under the trim (which we believed was included based on conversations at the initiation of work) and adding tyvek to the windows (which I did for >50% of the windows). I told him that the price was outrageous, that we didn't agree to any extra work, and I did much of the "extra" work that he was trying to charge for. Our contract states that any changes will be agreed upon prior to work starting and that both parties will sign, and payment will be made. Based on this clause, I do not believe that I need to pay this bill and told the contractor. We tried to negotiate with him for a total of over 6 hours on 4 different occasions and he wouldn't budge on his price or insistence that we owe him. Every time we say, we didn't agree to this, he claims that the change order clause in the contract doesn't matter. Now he has walked off the job and has left us with a gigantic mess, >6K in unfinished work, and several quality issues in the work (he shot nails through electric wires so several circuits in our home no longer work, windows are now crooked in their frames, etc). The even bigger problem is that he has left our raw wood siding unpainted and we are concerned about the effect on the wood. We suspect that he mismanaged the funds we paid him and is trying to add money to the budget to compensate. Who is in the right on the change order? What remedy do I have?...Read More
