I’m a small California GC and about two months ago we installed some large patio doors (6’ and 9’) soon after, we noticed some overspray from the factory. We called, set up a service call and I then invoiced client for full cost of installed doors. Client then complained that door was difficult to lock, normal in new fiberglass patio doors, and has held back payment that was invoiced, around 6k. Two months later, manufacturers service tech comes out and brings the wrong panel to swap and adjusts the door to where they told me it was operating within parameters. Lots of other small things have also occurred and I need to get out of there ASAP but still have about 25k of areas left to do. With the Coronavirus alive and well here, emotions are crazy and I need to make the right decisions. Btw, we have a signed contract as well as 9 CO’s and counting....Read More

We are in a circumstance with a GC who has not paid us. Upon information and belief the GC may be filing for bankruptcy protection. We have no contract with the GC. We have received NOTHING for this job. Outstanding is almost $14,000. Notwithstanding we have no contract, we sent the homeowner and NOI. In response, the homeowner wants us to order the final Electrical Inspection. They are holding back enough money that they can pay us directly. However, do not want to release funds until after inspection. We need to ensure we will get paid immediately after inspection, or have the right to place a mechanics lien. We also belief they may have asked a non-licensed electrician to perform other work since we were last at the worksite. We were last there the end of February. Again, we are a sub-contractor on this job. We should also consider the GC need be a party to the agreement. I am a sub contractor in a public project. after 3 years finally public entity has paid the final payment to general contractor, and even though general contractor has approved the total due, but still is claiming the last 2 change orders which is over 7000, were not approved and refusing to pay those 2. the total due at this time is over 35000, but he is trying to take that 7000 off and pay only 28000. we have proof from Public entity that those 2 are approved and paid. I did a job for a customer that lived out of town and had purchased a home in greenville aswell. We agreed I would be completed by Mother’s Day weekend. The cam in to town 2 days earlier on Wednesday. We were not there and the job was not complete. I had us schedule to finish touch up paint on Thursday and clean on Friday. They were furious it wasn’t done, even though we were not obligated to be complete for a few more days. I had a dump trailer, multiple expensive ladders, walk boards, and several high dollar milwalkee brand battery tools.total value $6000+. They refuse to let us come back and complete the job, refused a partial refund only accepting a full refund in exchange for our equipment. I offered $2000 back of $6800 just to satisfy and move on. I purchased a home to renovate in Arizona. I live in my current house. I had a verbal contract with a licensed contractor to remove an unground pool and trees in, etc in the backyard and do grading. After agreeing to take out a large pine tree at the last minute he refused, he has likened the house but will not show us receipts to back up his charges to us (pass on to us)of fill dirt and delivery of dirt to the home. We are a small company that started in November 2019. We engaged a subcontractor on a Cellular construction project. The subcontractor worked without a PO but submitted Invoices which we have been paying on time. Recently, they took off with the clients equipment (worth $30k) and now are threatening liens on sites if we don't pay them the balance ($32K) of their invoices. One of these invoices came due on 6/1 and the other comes due for payment on 6/8. We have sent them Conditional release of liens and have committed in writing (via email) to pay the agreed balance monies but the subcontractor refuses to sign the conditional release of liens until full payment is made. We have a feeling that the subcontractor will file liens to extort money out of us once we make full payment against these invoices. Questions - 1. Can they file a lien? They don't have a PO. 2. What are our options in this case? We need help! We are contemplating doing a police complaint against the material they took without anyone's permission. Thanks!...Read More

I am an electrical contractor that was hired by a contractor for work on a residence in Colorado. We submitted a formal proposal that was signed and approved by the contractor. We completed all the outlined work on the original proposal and additional changes as requested, and all services equaled the original proposal amount. Billing that was sent out was clearly outlined as to all services rendered and was the approved amount stated on the approved proposal. We have been paid approximately 50% of the proposed and billed amount. The contractor is now in legal mediation with the owners and are owed over $150,000 from the owner. The amount we are owed is $7575.44 of that $150,000. What is the best way for me to attempt to get funded for this amount? I have no direct contact with the owner or owners rep, and we are outside of 120 days to file a lien. My contractor stated they filed a lien and are having their lawyers talk. I am thinking of taking the contractor to small claims court (if I can being it is $75.44 over) however we have active jobs with this contractor and would like to keep a good business relationship. ...Read More
