Hello! We are materials supplier, and we are providing windows to the project. We signed 1 agreement, but this agreement is to provide windows for 2 building. Building A is near by building B, but they have different addresses, owner is the same. Should we send notice of intent to Lien and Lien should be filled separately for each building address? We have and other situation where we provide windows for new construction of few buildings and separate addresses are not determined yet. In this case should we use 1 address we have from our agreement? thank you!...Read More

I have built a home and the contractor gave me an extra bill for work he said he did throughout the 12 months of building my home. I had a 6 month contract which states he has to provide estimates up front for any extra work that he would do to the property that must be signed off by both parties. He took liberties throughout the project of dragging his feet over a whole year, lost labor, ordered materials only when he needed them instead of all up front and this caused numerous delays holding up my build for a complete year and it still is unfinished. He refuses to provide me with a breakdown of the extra work he did and just lumped it all into one lump sum bill. Some of the items he was under contract for he included in this lump sum. How am I supposed to know what he was working on under contract or extra stuff he claims? Is there an Illinois law that requires him to provide me with breakdown or will my contract suffice with legal rep to hold him accountable?...Read More

We had major issues with a contractor to complete the storm damage on our property. It took our contractor 14 months to finally complete the job and now he seeks the full remainder that we owe him. Yes, the job is finally complete, but it was a huge hassle on our part to constantly stay on top and push to finally have it complete. The initial contract was for $8500, then there was an addition for $6500 to cover additional service on the house. We paid $4000 of the initial contract up front and full $6500 for the addition. Theoretically, we owe them $4500; however, I feel like they should not be paid a full remainder because it took way too long, and we had to constantly push and push to have the job finished. I suggested a 15% discount on the initial contract of $8500 which I thought was very reasonable and generous on our part for just how late this job was completed and all the hoops we had to jump through to have it done (+ there are issues with installs and some damage left on property); however, in return I got a notice that they will file a lien on my property if I don't pay the full amount within 10 days. They are referencing an IL Mechanics Lien Act. So, they have an act that they can rely on and apply to get their money back. What rights do I have as a homeowner in such a situation? The contractor is not deserving of a full remainder amount we know we owe him. There should be some adjustment applied and I thought paying 85% of the job that took 14 months to complete is reasonable. There was no mentioned in the contract when the job will be complete, but we trusted the contractor it will be done within a reasonable time. We signed the contract in good faith. Can you please shed lights into this matter for us so we could understand what rights do we have as homeowners in IL in such situations? These contractors feel that they can do whatever they feel like it because they are protected by that mechanics act. How is the consumer protected here? Do we have any rights? PS - I did tell the contractor that this is not that we're refusing to pay the amount, we just want to pay the just amount given the circumstance. I had a company put in a new patio for me. The day they were going to pour it started raining and they called the concrete company 1 hour before it was suppose to be delivered and cancelled the order. An hour later the concrete truck showed up and was told that the concrete was not needed because it was cancelled. A week later the concrete company sent me a ""notice of intent to lien property". I want to make sure they cant file the actual lien because the truck was never on the property, I never ordered the concrete and their concrete was not even used on the project. Well, I went thru an adversary proceedings over a tuition debt. The proceedings took over two years to get a ruling, in which the judge ruled in my favor. Now when I filed for bankruptcy it was only in my name not my husbands, but the case proved that I was the primary care giver for our kids. Are general contractors required to send a notice to owners on commercial projects. We are building Burger King in Loves Park Illinois, which is in Winnebago County. We are not sure if the Owner of the project, which we have a contract with, is the owner of the property. They may be leasing the property from another corporation. I am a subcontractor in Illinois, and we have not been fully paid from the GC for a fire alarm system upgrade at 77 W Washington St in Chicago. We have been trying to work with the GC to get paid on a partial retainage from previous work and a change order to add stairwell door unlocking based on fire department comments. Our job was completed in June 2019. The GC told us that the money is owed to us by the GC (We have written documentation), we still have not been paid.
