Parties hired by someone other than the property owner will need to send a Notice of Intent to Lien before pursuing an Illinois mechanics lien filing. Typically, sending a Notice of Intent to Lien late will be fatal to mechanics lien rights. But, if the GC has sent a Sworn Statement to the property owner which let the owner know you haven't been paid, then lien rights will be available even if a Notice of Intent wasn't sent on time. Still - it's possible that a Notice of Intent to Lien will lead to payment even if it's been sent late and even if lien rights might not be available.
