Hello! We are materials supplier, and we are providing windows to the project. We signed 1 agreement, but this agreement is to provide windows for 2 building. Building A is near by building B, but they have different addresses, owner is the same. Should we send notice of intent to Lien and Lien should be filled separately for each building address? We have and other situation where we provide windows for new construction of few buildings and separate addresses are not determined yet. In this case should we use 1 address we have from our agreement? thank you!

You ask about enclosing Notices of Lien and eventually a Mechanics Lien claim based on the address at which improvements are made.

  • First, Mechanics Lien claims are effective as to each Permanent Index Number (PIN) where work is done. There are PIN's that contain more than one address, as well as addresses made up of more than one PIN. So, you want to file against the right PIN(s).
  • Second, Notice of Intent to lien should be sent to the party with which you contracted. The key is notifying the Owner or Owner's agent - who may or may not be located at the property on which work was done.

Yes, provided you are delivering the windows to the real property, you should lien all common addresses, legal descriptions and PIN#s.

You can file one lien for multiple properties for which you furnished materials under a single contract. The notice should list both properties and be sent to the owner, the GC and lenders, If any, of both properties. You must apportion the amounts due and list the last delivery date for each property in the lien.
