Contractor filed a mecahnics lien against my property, but I never received a copy of thr lien by certified mail, so the contractor never got my signature thatI received the copy of the lien by certified mail. But the contractor says it didn't matter that I didn't receive it because he has proof he sent it. Doesn't that negate the obvious reason that it is required to send a copy by certified mail so that the homeowner is supposed to receive it?...Read More

My husband has a associate degree in electrical work and has worked as a mechanic for years he rents a garage where he works on vehicles. he has a ein number but is not a licensed mechanic. The General GC hired unlicensed electrician (person with no license), checks were payable to a person instead of a electrical company. Also, the other subcontractors, Framer, Roofer were people with no business license from the state and with no occupational license by the county (as required); also checks were payable to person instead of a company. Is this legal? He submitted a mechanic lien for extra cost not established in the contract. Any suggestions, feedback would be appreciated....Read More

I have a project in GA. The General Contractor (GC) issued a letter of intent (LOI) and we started work. PM was supposed to send an AIA contract but after several days they sent a non AIA contract with lots of very stringent language and we asked to get AIA contact and they refused. We worked on the project and finished drgs sent to approval. Then the suggest to mark up the contract and we did as we did not agree many items and they agreed most of it. We signed the contract at and the GC pull the plug and did not signed the contract and cancel the project. Do I have lien right?...Read More

I was working for a builder, who wanted to use my business for Cabinet material, installation, and Labor. After invoices and drawings had been sent, she approved and while the job was being worked on, she continue to add more stuff. We added all of that in the invoice, anyways we finished the job and she hates the job and does not want to pay, we offer a discount, and she accepts. And she still doesn't want to pay. Since October she has been saying she wants to sue us for lack of work, but its February and we have never received anything from anyone. In January we reach out to the owner explaining that, this builder has not paid us and we gave her a letter for a notice to file for a lien. The owner then said, that this Builder has been paid and then the builder re messages us, and said that the owner is lying and had not fully paid her either... Events: -Subcontractor claimed he did not get paid by GC that abandoned my property project with 20% of work done with fully payment in hand. -Sub represented himself as wanting to help after GC abandoned, so I hired him directly to complete work. -Now direct contractor, he collected full payment from me, and he also did not complete work, and left damages. -I requested refund for work not completed, contractor agreed to only half refund of payment as per their refund policy and them starting the project -Credit card reversed payments filing in my favor, after proof was submitted that work was not delivered. -Contractor is now proceeding with lien claiming he did work and provided materials for property that he was not paid for. -Contractor not only didn't complete work agreed to, but he left damages that had to be repaired for additional cost with another company. -I have records of another company I hired after the contractor, that did the work the contractor is claiming he did. -I also confirmed that when he was subcontractor for property, he was paid for work he did not do, which is inconsistent with his claim that he wasn't paid by GC. Questions: 1. Can I claim funds that I paid to GC who then paid subcontractor, that subcontractor did not deliver for? 2. Can I represent myself in Small Claims, contesting lien? 3.
