i was wondering. if i provided materials and work outta pocket and the job wasnt paid for but im not licensed yet because of money issues if i had any options. job was quoted 300 and there was a verbal agreement. Hello - I hired a handyman to build a deck for me on my property. He made many mistakes that I kept having to identify and have him fix performing very poor work, and over inflated his labor charges. He could have also over charged me for materials as I never saw those bill and things would need returned and he claimed he didn't charge me, but I would never really know. He never put down how many hours he worked on his weekly bills just a large lump sum of money. I started questioning it on his last bill after many mistakes were made and the bill was getting out of budget. So I made him report on his hours and what he was actually doing. His last bill was way out of line and I was over charged. He did not have an explanation for it and I did refused to pay that labor in full as it wasn't accurate. He has now been threatening me in many ways, one of which is to file a lien on my house starting now. He never had a contract or anything in writing. If the contractor's company has been paid the intial total for home repairs, submits a supplemental to insurance company, owner of home holds supplemental payment as work/material on supplemental wasn't preformed or materialized in addition homeowner tried to address issues with contractor. 8 months later independent state licensed Engineer investigated and found work not completed/preformed, done poorly leading to more damage, and said case was in process of being subrogated, by insurance company can a lien still be perfected on the home owner? We engaged a contractor through Coldwell Bankers RealVitalize program. He was suggested by our listing agent. The remodel was to put in a new tub/shower and tile and new walls. Long story short, he did not finish the job we engaged him for- numerous items from the contract/itemized estimate were not completed. He destroyed an existing window and trim, did very shoddy finish work, left cracks in our walls and put in a new floor that is uneven and bumpy. the re installed toilet is on a tilt and runs. the new shower head is not firmly mounted and the whole tub unit leaks. Another contractor reviewed the work and said it all needs to be gutted due to improper construction. The pipes were left hanging in the wall and not secured to anything or anchored. We did not pay him the second half of the invoice total as the job is sub par, incomplete, and the bathroom non functional. Coldwell's program put the initial deposit down and are trying to recoup that money. Can he put a lien on our home or sue us for the balance?...Read More

i am a contractor, James P. I have a customer asking for money back after a down payment. i have spent money on project and have been harassed during the project changing the the plan in multiple ways and in their order. i was let go simply and also with no cause; i was working on 3 parts of the contract, being threatened over the phone by the husband to the point he was so angry that when the agreements that his wife made he didn't even stay at his own home. i have probably had over 50 to 65 phone calls since the start and numerous messages over texts. they are asking for 1900 after they would call me 4 to 5 times a day so i had to stop on other jobs loss of labor and time to finish the job but they never allowed me to finish anything that i had started. if or if not, they have someone else already working on it what are my options because I've heard from multiple people that since they would not all me to finish the work and i had already started but couldn't work due to weather. do i have to pay them anything at all ? to me they hired then fired me without cause and they made that decision and from 5200 they dropped dropped the return to 1300 in about two weeks demanding it in cash. do i owe or do i just let it go to trial and i was not allowed to finish any of the projects that i started? do i owe them anything?...Read More

We are a lighting manufacturer who provided materials for a job site in Ohio. Our products were purchased from a distributor and sent directly to the job site. The distributor sells our products to the contractor or end user. We have not gotten paid yet, and want to possibly file a lien in order to do so. We learned yesterday that our Distributor is actually going out of business. I am not sure if they are filing for bankruptcy or what their status is. When I spoke with them yesterday, they said they would send me a contact of who to call to find out what and if we will get paid. I have not received anything yet. I hired an Engineer to pull permit for a mobile home. He asked for $2,500 down payment. He mentions he believes it will be between that and $3,000 at $100 for him and $60 for his assistant an hours plus .55 per mile. Shortly before the process is done he informs me that it went over and I owe him another $6,000 plus. I paid it. A couple of days before final inspection he tell me there will be additional $600. It passes final inspections. I pay him in cash the last of the money I owe him and was surprised he didn't ask for the additional $600. He gives me all the paperwork associated with the project and that's it. Now 5 months later he calls me and says that I owe him an additional $3,500. For what I don't know. Can he bill me for something 5 months later? Can I ask him to send me an itemized statement of charges which he never has supplied me with?...Read More

I am the homeowner who signed a contract for someone to remodel my home after it was damaged. contract stated all materials and labor were included in the quote.Only way they can change is if it was in written request. We are at the end of four months on a two month job. Contractor is trying to force me to sign a new contract for my insurance to pay more and for me to pay more. I was threatened that if I do not pay the difference if they will put a lien on my home and remove stuff from my house they put in here. My insurance company refused to pay any more instead of the Contractor saying they’re going to sue me even though they have not finished the job. I am a material supplier and filed a stop notice for a job with the County of San Diego and received the following message: "We have received your legal notice under Civil Code Section 9350 et Seq., dated June 19, 2020, claiming an amount due for work furnished to Prime Contractor (optional Power and Cable Solutions) pursuant to a public works contract. The legal provisions cited in this notice are not applicable, because the agreement between the County and Optional Power and Cable solutions was for a purchase of goods and not a public works contract." Also, A Third party company placed the order for the County, and the county installed the materials themselves. The county did not require the third party company to provide a performance bond.
