I am a contract pumper in Reagan County Texas. I pumped wells for Endeavor Energy for many years and was paid $12,180.00 a month for contract pumping. Endeavor sold the wells that I pumped to a company called Digital Operating Company LLC on 8-2-2022 and I pumped the wells until September 24, 2022. After I sent an invoice for September pumping on September 18, 2022 for $9000, a cut of $3,180 to try to keep my job, I was sent an email at 12:42PM on September 23, 2022 stating that they no longer needed my services and when this is completed, you will receive final payment minus expense for cleaning up your unreported spills. I made every well on the September 23, 2022 and there were no leaks or spills so I contacted the Railroad Commission to see if any leaks had been reported on any of my wells and they said no. I contacted them on several occasions about paying my invoice. On November 3, 2022 I contacted them and said, "We have been in contract with Railroad Commission and they confirmed there were no reported leaks, we are expecting payment for services provided during the month of September 2022, If we do not receive payment by November 9, 2022 we are prepared to file a Mechanic's lien again Digital Op." On November 8, 2022 at 4:28pm Leslie wrote, "We will wire you payment for 23 of 30 days of pumping services for the month of September 2022 ($6,900) tomorrow. Please provide wire instructions and we will send first thing in the morning." On November 9, 2022 at 9:14 am I replied. "Leslie, The amount being prepared for the mechanic's lien against your wells is for my invoice of $9000. I pumped these same wells for Endeavor by the month for $12,180 a month and I was forced to come down to $9000 in order to try to keep my job once your company took over. This was a $3,180 cut from what I normally charged. In lieu of the fact that you dismissed my services with out any forewarning, I expect to be paid the monthly invoice amount of $9000 as agreed upon. I work by the month, not by the day. Attached are the wiring instructions from my bank. They answered with a email threating to counter sue. As of today, nothing has been paid....Read More

I have a simple agreement to purchase a house with $600 monthly payments.The agreement originated with the husband-owner. The agreed upon price "was" $60,000 and in the middle of purchasing, owners divorced and wife got the property. Due to some complications with husband-owner's tax debt, "he" was unable to legally tansfer the property. I agreed to an Aditional $10,00 in monthly $600 payments....since the Wife-owner had no such incumberances. However, upon my making my Last Payment in November 2019....after having paid $70,000....in Monthly $600 payments since August 2012 AND residing in the house this entire time, Wife-Owner wants me to continue paying $600/month (Because they never paid off $10,000 Mortgage...which is WHY I agreed to the extra $10,000....when she told me about the unpaid amount....).and has now tried to evict me. The local JP threw out Eviction because we are not "RENTING - We are BUYING" AND...we have met our obligation of payment of $70,000.00 in full. Problem....I've NEVER bought property before, and the only document I have is a simple signed statement from Husband Owner stating we are purchasing the property fro $60,000 @ $600/month. This statement was written after we had paid about $20,000 and was hoping to get financing and pay off the house early....that is when I was inofrmed Husband-Owner had Federal Tax Judgements against im and HE would be unable to execute the Title Deed Transfer. I DO NOT have an Official Contract nor FULLY Drwan Agreement....Only the signed statement and all th communications with the WIFE-Owner since she took over ownership. ???HELP??...Read More

Hello, I have a customer that we did work for from June to October and refuses to pay. She claims there is additional work required however, the work she wants done was not included in the scope of work on the estimate/contract she signed. We have sent numerous invoices and I filed an Affidavit of Lien on Homestead on 11/1. What do I do from here? I'm unsure if I missed a step or if there was a different document I needed to complete. I was contacted by the building owner about a mechanic lien I filed. I was told the project engineer spoke with the subcontractor (JN Glass) that has failed to pay me for my service and material and stated to them he had a dispute with my total charges. They emailed him stating he should resolve this matter with me. They also said they signed a lien waiver from the subcontractor (JN Glass) indicating he was paid in full. How do I move forward in this situation? It feel as I am back to my original position. The material in that building is still unpaid for as well as our labor. What can I do?...Read More

I started a fintech company named PayUp, that does invoice factoring in Real Estate. I spoke to Frank and he asked me to put my question on here so that we could get it clarified. 1) We want to know our legal mechanics lien rights as an invoice factoring company if we are purchasing invoices after job completion (therefore cannot send intent to liens before the job has started etc)? 2) Can the mechanics lien be batched by selection of invoices, or does it have to be on every invoice? 3) We currently work in Texas, Florida, NC, & SC but plan to expand throughout the US - which states does this cause an issue with, and which states are we good to purchase receivables whilst maintaining lien rights?...Read More

Hello, I would like to have a better understanding on how often we should send non-payment notices in TX. For example - if work has been done in July and August of 2022. July non-pymt notice was due by the 15th of October, (and imagine it was sent); and August is due in November. So when we ready to send August non-pymt notice by the 15th of November - do we need to sent July notice again or should we only send it once (which imagine was already sent in October) ??...Read More

Hi, Billd offers 120 day payment terms to subcontractors on commercial jobs. We pay the supplier up front on the contractors behalf. We have an opportunity to fund software. I have mechanics lien on my rental (non-homestead) in Texas. Upon research, the sub did not give me any notice so I am assuming he did not "perfect the lien" The lien will expire in about 6 weeks as he filed it last year. How do I go about getting it off my record once it expires as the sub is refusing to remove it even after I pointed out he didn't follow proper procedure (not to mention I had to have his work COMPLETELY redone)? I am a general contractor that has completed work ( installed new ducting ) and the customer has refused to pay. I sent a certified letter stating that the account will be sent to collections, upon receipt customer called and threatened to complain on all formats of ratings as well as the BBB if we send to collections. Sent it to collections and customer offered very minimal payment with requirements of lien waivers for his property as well as all the places he contracted our services for which exceeded $12,000. Customer offered $2000. Collections advised us to sue our former customer. I have truck tracking and signatures approving the work as well. The job was completed 08/2021 but we have been in contact with this customer throughout the past year inquiring about payment. What are my legal options?...Read More
