Texas lien waivers must be provided in one of the required statutory forms in order to be valid. This makes things much simpler. Conditional waivers are always the safest route for contractors to use in exchange for payment. A conditional lien waiver is just as valid and enforceable as an unconditional lien waiver with one key difference. See Conditional Lien Waivers vs. Unconditional Lien Waivers. A conditional lien waiver will not effectively waive your right to file a lien until payment is made. It even says so directly on the document itself, "On receipt by the signer of this document of a check... when the check has been properly endorsed and has been paid by the bank on which it is drawn, this document becomes effective to release any mechanics lien right."
