We missed the deadline to file a pre-lien on a commercial project that we supplied material to. If we file a mechanic's lien before our final deadline, will it still be valid if we didn't send the pre-lien?...Read More

I have a question about the lien process. If a supplier sells to a contractor and the contractor picks up the materials and takes it to the job site (and the contractor does not pay for them) does the supplier have lien rights? Even though they did not furnish/deliver the materials directly to the job site and the contractor did a “willcall”...Read More

With everything going on these days I'd hit Financial hard times and I had asked a friend of mine if I could rent their RV. We Came Upon of an agreement that I could stay in their RV for $400 a month and 4 payment of that $400 a month I was too repair the RV it maintenance and upkeep to the RV and yard. Anyting over that $400 a month he would reimburse me for whether it be supplies materials or anything else needed to establish the upkeep and maintenance of the RV and yard. And now they are refusing to pay me for my labor and supply cost that I have had to put into the maintenance and upkeep to the RV and yard. And since I moved in to the RV March of 2021 I have put in approximately 8 to 10000 dollars into labor cost and materials and he is refusing 2 pay me the difference and is trying to say I owe him money for staying here in his RV is this something that I can file a contractor or mechanics lien on?...Read More

I hired a contractor to do remodel of my laundry and bath in my house. We had no contract, but he gave me a bid of work that I agreed to, but didn't sign. We had a verbal and written agreement that if he was not going to come to work daily and give full day's effort, that we would settle up and part ways at that point. 1 and a half months into a 2 week project, the contractor failed to show up for 2 days and we decided to fire him. I paid for all the materials during the job and gave him 3 different money draws to help him rent equipment and pay his subs. He is threatening to file a lien on my house, but we didn't have a contract and he broke his agreement of working every day. The contractor also did not give us a Preliminary Notice before starting the job. So, can he file a lien on my home?...Read More

I hired a handyman to install spray foam insulation. He was paid in full prior to the project. He verbally told me he would be doing the work, his invoice states he will be doing the work, the invoice is under his name (not a company name). He (without my knowledge) hired another company to do the work. 73 days later this other company came to me door. I gave him the address and phone numbers for my handyman. He stated he wasn't paid..and I thought it could be a scam. 85 days post install they filed a lien on my property. This was the first time I had the name of the company, and dollar amount. Is this lien valid? No pre-lien notice, they were not authorized to work on my property, my handyman did not have the authority to bring in additional people, and the amount this company charged was well over the expected price. Last, the work has unfinished repairs....Read More

One of our employees submitted the Intent Notice instead of forwarding the Prelim. Now we are coming up on the Mechanics Lien due date. I'll forward the Mechanics but I really don't want to get us in legal trouble if we know that this is in any way illegal. Thanks!...Read More

We filed a pre lien and in the fine print of our contract it says the subcontractor must keep the project free of liens. We have not been paid on the job and the GC said we are in breech of contract for placing the prelien...Read More
