Which of our company names should we display on our preliminary notices & mechanics liens?

OhioConstruction ContractPreliminary NoticeRight to Lien
Anonymous Contractor

Our contracts are signed using one name, but our customer makes payments to an alternative name for our company. Should we list the name we used for the contract on our payment documents or display the alternative name since that appears on the checks? For context, we will be sending notices in states such as Ohio and Florida.

If you're operating under two separate names, it might be wise to include both business names. Using the company's legal name as well as a "doing business as" or "dba" designation is pretty common for contracts, notices, checks, or other documents. For example: (Legal Business Name), doing business as (Operating Business Name). If you absolutely must pick one name or the other, it might be better to use the name that the work was contracted and actually performed under. However, including both names with a brief explanation of the relationship between the business names would likely be the best option.
