How can I go about collecting funds if I've failed to file foreclosure by the set date?

Unfortunately if you've missed your 6-month foreclosure deadline, a CO mechanics lien is no longer an option for recovery. But that doesn't mean you can't still legally pursue your claim for non-payment against your customer. These types of claims are typically based on actions for breach of contract or unjust enrichment. Furthermore, depending on the amount in dispute, you may be able to bring the action in Colorado Small Claims Court if the amount is less than $7,500. You should contact a local attorney to advise you on your options. We have a few Colorado construction attorneys in our Expert Center Community you can reach out to personally. Good luck! Here's an article that explores these and other recovery options: What Do I Do If I Miss a Mechanics Lien Deadline?

If you are in need of collecting from a business in CO, we are licensed and bonded there so email srauch@rauchmilliken.com or call me and we can discuss how to get your money. Best regards, Steve
