I only have one question. When a subcontractor sign a contract with the prime contractor does the prime contractor has the 3 days right to cancel with a subcontractor? Or it is only between the prime and the buyer?
Hi Mauricio! Thank you for your question. The California Three-Day Right to Cancel applies to homeowners. The property owner will have the right to cancel their contract with a direct contractor within 3 days, but the Right to Cancel notice is silent as to subcontractors. While a direct contractor is not entitled to cancel contracts themselves using the Three-Day Right to Cancel, if that direct contractor's contract is cancelled by a homeowner, presumably any contracts they entered into for that job will be unenforceable.
