Owner paying after a work

NevadaMechanics Lien

I'm the owner. Painter paint the kitchen the last 14th. I have ordered my bank same day to pay him for the remaining balance 385$ for a total work of 3385$. Bank has issued a check by 19th, it takes 3 to 5 days to be received. Painter wants to put a lien. What I can do?

If the last payment has been authorized and is pending, it seems like the potential lien issue may just be a communication problem. First, while possible, it is unlikely that a contractor is actually going to file a lien over an amount due of $385, it is likely not cost effective. A lien is not applicable for money already paid, so when the payment is received, there is no need for the contractor to file the lien. If desired, when payment is made, a final unconditional waiver maybe obtained to provide a "receipt" for payment and peace of mind regarding future liens. If the contractor files a lien anyway, it must be released after payment is received. Open communication can avoid many potential issues on construction projects - and this seems like such a situation. Let the painter know that the money has been requested, and it is coming. Show them the request, if needed. It appears that a lien can likely be avoided here.
