Our contractor abandoned our project...

GeorgiaConstruction ContractPayment Disputes

I believe our contractor abandoned our project. The project started in October 2018 and the last time they were on site was April 2019. What legal rights do we have? Can we get the money we paid? Since the project was never completed and the contractor wasted our time?

If a contractor has only sporadically showed up at the job site then fails to appear for several months without contact, then there's a strong chance that'd be considered a material breach or even an abandonment of the contract. If that's the case, then an owner would likely be entitled to go after the contractor in order to recover amounts that were paid beyond the value of the work performed. Plus, damages could come into play, too, if things came down to that. Of course, no contractor will willingly fork over amounts they've already been paid. So, it might require a demand letter and/or legal threats in order to bring them to the table. Further, it'd be unsurprising for a contractor to try and proceed with work rather than to return amounts already paid. If negotiations don't go anywhere, then it might come time to make legal claims to try and recover payment. And, if that's the case, it'd be wise to consult a local Georgia construction attorney. Though, claims might be brought in Georgia small claims court for disputes of $15,000 or less.
