Notice of Rights

Hi there, I work for a contractor and we filed a lien on a job. It came back saying it was rejected by the county it was filed in and that it needed a notice of rights. Is this the same as the intent to file a mechanic's lien? We've filed a few liens and have never seen this.

A Notice of Rights is a lesser-known Missouri notice, and it's different from a Notice of Intent to Lien in Missouri. A Notice of Rights is generally only required on residential projects where the property owner has filed a Notice of Intended Sale. If that notice was filed by the owner, then the lien claimant must file a Notice of Rights at least 5 days before the property is sold. With all of that being said, it's also possible that the recorder rejected your mechanics lien in error, which happens from time to time. So, contacting the recorder and asking for more information about the rejection is perfectly reasonable, and it might help to provide more insight as to why the lien was rejected and how that can be avoided going forward.
