Unless full payment has been made, final mechanics lien waivers won't be appropriate. Instead, a partial or progress lien waiver would be more appropriate. If payment hasn't been made yet, conditional mechanics lien waivers should be used. But, if payment has been made, then an unconditional mechanics lien waiver may be appropriate.
To be sure, Texas strictly requires that statutory lien waiver be used. So, if you don't use one of those forms, the waiver won't be effective.
