Retain a construction attorney to evaluate your situation, and to provide advice and services.

If you have filed a mechanic's lien on the wrong property, you could be liable for violating the Texas Fraudulent Lien Act, which can impose statutory damages of $10,000, or actual damages, whichever is greater, plus attorney's fees. So, releasing an invalid lien, especially when requested to do so to permit a sale to go through could save you a lot of headache and expense.

Good luck.
