Do we have any lien rights on tribal land.

WashingtonMechanics Lien
Anonymous Subcontractor

Hi, We did work for a Contractor on residential homes that were on tribal land. He is holding out rather large partial payment for frivolous reasons. My understanding is because its Tribal housing that as a subcontractor we have no lien rights? Is this the case? Does this include no legal rights at all to get a lawyer and go to court? Thank you

When work is performed on Native American land, that land will typically not be subject to mechanics liens. Levelset discusses that in detail here: Do Lien Rights Exist on Native American Land? However, that doesn't mean other legal claims won't be available - such as a breach of contract action. Of course, note that before legal action is taken, there are other less-formal steps that might help to recover payment. Options like invoice reminders or demand letters may help to get payment talks moving in the right direction before something more serious is necessary - and they can let a customer know you're serious about recovery.
