Once filed, an Indiana mechanics lien will only last for a period of 1 year from the date of filing. If you have a valid claim and are still within your enforcement deadline, then yes, you can file a foreclosure action in the circuit or superior court in the county where the property is located. One optional step you can take before filing suit is to send a Notice of Intent to Foreclose. Consider it a final warning that if you're not paid, a lawsuit will be filed. This will get the ower's attention. If not, then you may want to file the foreclosure action.
