We are a supplier and I am having difficulties getting across to our customer that we do not supply Conditional Waivers for progress or partial payments unless we are paid for supplies. I am new to this system and am trying to understand fully what the process is for conditional and unconditional waiver releases. From the instructions I have, my understanding is that the releases do not get sent until payment is received. Please advise on the process, whether conditional and unconditional on partial payments can be sent before payment is received. I need to relay the process to our customer as soon as possible. Thank you for your assistance....Read More
Hello Support, I hope this message finds you well.
I had contracted a Painting(Garage & Laundry room and Garage Epoxy Flooring) to a local contractor in Florida (Brevard County). The total cost of the project was about $1850 dollars. The scope of the project outlined in the initial estimate was not followed precisely, but I choose to follow the contractor's professional advice. The issues that arise stem mainly from the epoxy part of the job, having several air pockets on the floor resulting from epoxy not adhering properly. After having a call with Sherwin Williams(Brand of Expoy used) agent, she advised that epoxy should not be poured onto fresh concrete or should be given weeks of drying time before doing so. The pouring of fresh concrete was not part of the scope of the project and it replaced 'repairing of cracks' and acid washing and scoffing the concrete. Anyway, the contractor dealt with all of my objects and the job became almost salvageable. The final aspect of adding the prescribed amount of clear coat (3) was not done in a timely fashion or as per the product specification required. Sherwin William's brand of epoxy clear coat requires additional coats to be added before 72 hours window. Here is the contractor took weeks to respond back to my message after I advised him that I'll get someone else to do finish or redo the job. He finally replied and hurried someone to come finish the job. I told him no one is touching the job unless the specification of Sherwin William is followed;re-scoff before adding clear coat since it was way beyond the application window. He then threatened a Lien on the property via Text. However, we came to an agreement that if he would take the risk of adding the clearcoat and everything turn out favorable after 72 hours he will be paid and so far the finish looks fine. Now before paying him, I need a legal instrument that would protect me from any future threats, and so i was looking at your conditional waiver. Is this the right legal instrument to use? Be advised I've already given him a 50% advance payment as well.
Thanks
Regards

As a construction company that elicits work from sub-contractors in the state of Illinois, is it possible to create a lien waiver that is applicable to multiple instances of work rendered?
For example, either:
1. We can create a single waiver document that outlines all the projects rendered with a subcontractor as it pertains to multiple job locations and job amounts at a specific given time (weekly).
Or
2. We can fashion some contractual waiver of lien that suffices as a general waiver sufficient for all projects performed in a given year- so long as the division of subsequent payments, and the breakdown of such, is outlined in the contract.
Is there any legal way to fashion either of the two aforementioned scenarios in the state of Illinois? ...Read More

Here is the situation
We are fully installed and currently in the PTO stage. The PTO application was submitted to the utility on 11/02 and is currently awaiting their approval. This does leave us with the chance that the utility could ask for a change to be made on site.
We have not been fully paid yet. If the notes on the processing page are correct, we have only received $36.232 and are awaiting further payment of $53.098. The lien release affidavit does give the option to provide a bank account number for the final payment to be transferred to, if we are comfortable providing one....Read More
Our company (we are a supplier) received a Conditional Waiver and Release on Final Payment from one of our customers with 3 properties listed. 1. Are we allowed to sign off on documents with multiple properties listed or should we have a document per each property addressed? 2. On the Conditional Waiver and Release on Final Payment, to our knowledge 2 out of 3 properties the job would be finished and completed for while the 3rd property we were informed the customer would want to place an order for tomorrow. May you please provide the guidelines or technicalities on if we can still sign the waiver for this scenario/ Conditional Final Payment Waivers? ...Read More
