Can I sign this Conditional Waiver and Release on Final Payment?

TexasLien Waivers

Our company (we are a supplier) received a Conditional Waiver and Release on Final Payment from one of our customers with 3 properties listed. 1. Are we allowed to sign off on documents with multiple properties listed or should we have a document per each property addressed? 2. On the Conditional Waiver and Release on Final Payment, to our knowledge 2 out of 3 properties the job would be finished and completed for while the 3rd property we were informed the customer would want to place an order for tomorrow. May you please provide the guidelines or technicalities on if we can still sign the waiver for this scenario/ Conditional Final Payment Waivers?

You really should retain a construction attorney to review and evaluate your legal position based on the contract and pertinent documents. The form of a Conditional Waiver is set by statute so the attorney would have to review what was provided to you to determine if it complies.

You can sign a Conditional Waiver with more than one property listed, but you should not file a mechanic's lien with more than one property listed.

Good luck.
