Will a mechanics lien go away after so many years in ND?

Mother has property in ND we are looking to sell and someone put a lien on in back in February 2007. Is that lien still in effect?

In North Dakota, an action to enforce a mechanics lien must be initiated within 3 years from the date on which the lien was filed. While the time for enforcing the lien has passed, as you mentioned, it still exists in record. Because no action was taken on the lien within the 3 year time frame, the lien will be deemed satisfied by the clerk of court upon a request of any interested person. As a result, the clerk will certify to the recorder that no summons or complaint was filed and the lien will be deemed satisfied. Then, a verified certificate of such will be recorded.
