Stop Notice Received - need to pay and get released

CaliforniaStop Notice
Anonymous General Contractor

We received a stop notice and are ready to cut a check and want to know the best way to ensure it gets released?

Although you have provided limited facts and we would need all the pertinent facts to properly analyze your situation, you should get a signed Conditional Waiver and Release Upon Final Payment (with no exceptions), and insist on draft copies of the Unconditional Waiver and Release Upon Final Payment  Release of Stop Payment Notice -- originals of which should be given in exchange for the check you provide.  You may or may not also need a Release of Contract Rights depending on whether you have a contract with the claimant and other factors. ----CN
