You have 90 days from the date you recorded the lien to commence a foreclosure action or the lien becomes ineffective

I agree with counsel. It's not enough just to record the lien. The lien will expire unless you file a lawsuit to foreclose the lien within 90 days of the lien recording date. You can also file a 2nd lien if the time for filing liens has not expired. An experienced construction attorney can help you with this.
