Signing a notice of Commencement

FloridaNotice of Commencement

There was a new roof put on my mothers house, however, she has passed and is unable to sign the notice of commencement. Am I able to sign it as her heir while we are waiting for her estate to be closed out since the property hasn't been transferred yet?

Unfortunately, the Florida statutes are very clear that the owner must sign the Notice of Commencement document. The statute goes even further and states that no one else is permitted to sign in his or her stead.

It might be helpful to reach out to a Florida construction attorney to verify if there are any exceptions to this statute in regards to your case.
