I filed my notice of intent to lien in November. I plan on filing the lien by the end of Jan 2021 if no communication comes from the project. Can I add the cost of filing my lien to the projects invoice?
Generally, a mechanics lien should be limited to the amounts owed for work done - and extraneous amounts like costs and fees should be left out. With that being said, if the lien must be enforced, then it's entirely possible that costs associated with the claim might be awarded to the prevailing party. Further, when negotiating the release of the lien claim, it's common for claimants to demand that the other side pay the cost of filing the lien on top of what else is owed.
