Refund of non refundable deposit when fired.

I had a general contractor come to my home to give me an estimate on three bathrooms remodels. . He started the job with a 50% deposit. The first two bathrooms that we’re done we’re done poorly and took triple time he quoted me for. After three months of trying to accommodate his needs I had to terminate him. Now he wants to keep the full deposit for work that has not been done and work that was poorly done. What are my rights?

I forgot to mention he refers to the contract as deposit is non refundable. Even for unfinished work or work never done?

This is a difficult situation because you seem to have started reacting without planning. You need to DOCUMENT his deficiencies and shoddy work, Document his delays. Document all correspondence and verbal conversations, text messages, etc. between you and him. In short Document EVERYTHING. Since you have kicked him off the job you will need to get multiple quotations to finish the work.. correctly ... from licensed contractors. From a damages point of view you agreed to pay the full price to get three bathrooms remodeled (neglecting the time factor)... .you got 2 done albeit shoddily. So whether you are due a refund depends upon the difference from the original quote for all the work, less the quotation to complete & correct the shoddy work. If it is more than the deposit he owes you a refund. If not, just get the work done.
