Public Works Job Gone Wrong: Can owner/agency choose to 'remove remaining scope' from contract in lieu of paying?

Scope Work is recorded as 99% completed on job. Instead of agency paying outstanding balance and closing out the job, they choose NOT to terminate contract - but 'remove remaining scope'. How is this legal?
