A general contractor recently filed a Mechanic's Lien for a not-yet-completed project at our property. We have tried to negotiate for the project to be completed, but are at an impasse. As a property owner, can we demand the contractor file suit, even if the lien hasn't been recorded on the County Recorder's website yet? We received notice of the lien filing, but haven't been able to verify that it was actually recorded at this point in time (likely due to delays due to COVID). Also, if we demand suit, could the litigation coverage from their insurance coverage kick in? We would like to resolve this to keep this out of court, but that may not be possible.
