My lien rights are up on a project, can I still get paid for retention not collected?

We're a Subcontractor and we were not paid retention on a project. However, we passed the deadline to file a lien. Is there another way to get paid the retention owed to us for the project? Also, we never received a Project Completion Notice.

If your missed your deadline to record a lien (and this is a private project), you can still try to recover from your customer. There may also be prompt payment penalties availabie if your customer has been paid and has not flowed the money down to you.

The answer is - Yes. You can sue for breach of contract. On a written contract it is 4 years; 2 years on an oral contract. Good luck.
