Mechanics Lien-Notice to owner

I am the contractor for a concrete project completed at a residential home in Missouri. Our contract states "Unpaid invoices may result in a a property lien in accordance with applicable law" and is undersigned by the customer. The project is completed and the customer wrote a check that was returned NSF and now does not return calls. We did not provide the Missouri specific Notice to owner language of M.A.S. § 429.012. That said, because the check has bounced, technically no payment has been made. Can I still provide that notice to the property owner and be eligible to file a mechanics lien in the event they do not pay? No subcontractors are involved.
