Mechanic's lien deadline question

A concrete subcontractor filed a preliminary notice and has completed their work on the house I am building, however the build as a whole is not complete. I paid the contractor for this work, but he neglected to pay the subcontractor, and has abandoned the project. What is the deadline by which the concrete subcontractor must file a mechanic's lien? Is it 90 days from the completion of their concrete work, or 90 days from the completion of the entire house?

The deadline generally arises from project completion, but if there is abandonment and a cessation of work that could effect the deadlines. You should consult a lawyer to review your specific facts and advise you on the deadlines and timelines you are looking at.

The mechanic’s lien period starts from completion of the entire project not just the sub’s work. So the sub would have 90 days from completion of the project (I like to use the date the project received final approval from the Building Dept.) to file their lien.
