Materials requested, finally arrived, but not yet delivered. I have now left the job due to the hostile environment.

Texas

I am a commercial general contractor of 40 years next May. I was initially invited on this job to advise about ways to "open up" this house gained by the wife’s inheritance. I later gave pricing for carpenter services, ceramic tile installation, some window replacement, and flooring labor/materials. I also started providing "other labor only services" and, by her words, became "her General Contractor". (She is the primary contact person, as it was her fathers house, and her husband is retired military, absent of all construction knowledge) I'm normally office personnel, but I didn't mind the physical challenge, because I'm 69 and wanting to slow down. I'd soon become the "go to" guy on site by all of the subs as well. The owners wanted to do all of the demo, and provide all of the materials to save money. While demolishing the walls, the owners cut every wire without regard to circuit runs, thus the wiring need to be re-identified to specific circuits, an electricians nightmare. The electrical sub immediately ran into owner attitude difficulty, for instance, when the owner wanted them to use salvaged nail-in boxes, when "old work" boxes were needed. The owner saw the electricians as spendthrift guys. It became one argument after another until the electricians left the job. They quickly became strong adversaries. I kept working on my tasks, all the while removing myself from the electrical dealings other than to draw an electrical plan and forced the owners to sit and approve the electrical layout. I was constantly being asked questions and for advice, however. The owner's husband had cussed me out for the 3rd and final time, so I left, on Tuesday (8-2-22), saying I'd return on Thursday to remove my tools and avoid being on site while he would be there. They were to have been out of town Thursday and Friday but, she met me on site Thursday morning (8-4-22), crying about finishing the project and telling me Joe was banned from the job except for after hours when I'd be gone. She and I both knew I am the most knowledgeable, and best choice, to finish the work, and could quite possibly get the electricians to return. Crying still, she asked me to PLEASE stay to completion. I agreed and was also able to convince the electricians to return Monday 8-8-22. All was going well, until Doris came to the job that Monday night, demanding I not pay "more than $2000" to the electricians to finish. She demanded to know "deal" I'd made. I made no new deal, other than I agreed to be the buffer between them and the owner. They agreed to continue the per day rate originally made by them and the owner, expected back wages to be paid, and to be compensated for any necessary miscellaneous materials. She was wanting a limit to the final amount and I knew this was not a definable number because of the tangled mess of wiring in the attic caused by the owners demolition. I didn’t try to talk with her and explain ALL OF OUR CONVERSATIONS as she was not listening to my responses, and has shown a continued habit to listen to, and hear only what she wants to hear. This mis-information spilled over the husband, then to his son (who now thought he could be a new "buffer") and then, to me in a hostile manner, so I left again 8-9-22. Now,,,,,,, I have claimed $2,068 of miscellaneous materials, equipment, and labor expended with my NOI sent (via e-mail) last evening. I'd originally (via my letter 8-15-22) claimed $3,856 owed which also included additional materials (I've since returned for my credit) and special order, special sized, replacement windows as requested by them last April. These windows arrived to my supplier last Thursday (8-11-22). I have no faith I will be reimbursed, much less be paid the NOI amount claimed if I deliver these windows to the job. Do I file my lien for the $2,068 only, or can I include the windows?

Include the windows and have them delivered to the job.

Next does the ONWER live in another house somewhere else so this is not her homestead?

If not then go full blast and tell the electricians and everyone else to do the same thing, FILE LIENS ASAP

Once all liens are filed then you will have 1 year to file suit and sue for the debts and to foreclose your liens
