What can I do to get paid for labor in Maryland if no lien or pre lien waivers can be sent per MD statue? Do we have to use a lawyer? If so, would anyone recommend an attorney in this field in MD?
Any person or entity having furnished labor or materials to a private construction project in Maryland (ie, non-government project) may file a mechanic's lien if unpaid, provided certain other conditions are met, ie, it is new construction or otherwise a renovation of at least 15% of its value, and the statutory deadlines for notice and filing are met. Maryland has no "pre-construction" lien filing requirements.
