Prevailing wage laws require that employees be paid at least the prevailing wage required for the given work in the relevant location. So, if an employee is already being paid above that and is already receiving the appropriate fringe benefits, then that'd likely be sufficient to be in compliance with the prevailing wage requirements. Though, the employer will still need to submit certified payrolls which document and verify that the necessary wages are being paid. Regarding salaried employees - I'm not well versed in prevailing wage compliance in California beyond the basic prevailing wage and certified payroll requirements, so I'm unsure of how that should be handled. Though, if a salaried employee spends significant time at the job site, then they'd likely need to be paid at least the relevant prevailing wage. For more clarity on California's prevailing wage requirements, it'd be wise to consult a local construction or labor attorney who's familiar with California's prevailing wage laws.
