Intent to Lien

Hello, I filed an intent to Lien on my 'NOHO' project. I have a contract to build the pool from start to finish. From not only 24Hour Fitness who filed bankruptcy and I lost money, but now from the new developer. Without any notice, their project manager hired a different company at a lower price to plaster the pool that I built. They breached their contract with my company that included an amount of $40,000 (+) for me to plaster and complete the pool. They have not paid me the negotiated contracted price for plastering the pool. They never formally canceled the contract and have likely completed the pool using my plans, which they did not pay for. I have filed an intent to lien through Levelset. I have not heard anything back from Levelset or the client. Please I need someone to tell me what I need to do next. The $40,000 is needed to reimburse my vendors for products and services used throughout the building of their project.

If your notice of intent was sent, the next step is to record the lien, then eventually file suit within your foreclosure period. Please call to discuss if you would like help with that process.

I am sorry for the issues. The next step is to file the lien. I hope the lien amount is correct as if this is inflated you may risk the validity of the lien. Your attorney can make sure this is correct or can advise on this. 

What you should do next is hire an attorney to make a demand. People often think that a notice will automatically mean payment and this is often not the case. Getting an attorney involved could resolve this but this is also not guaranteed. You are free to file your lien and then foreclose on that lien (this must be done in the time required) or file suit. Thes are complicated matters in district court and require legal advice. I hope your contract included an attorney fee clause.
