I’m about to file a 90 day lien notice in Illinois. It suggest to certified mail the defendant? Can I tact on the cost

IllinoisMechanics Lien

I am about to file a 90 day lien notice in Illinois. It suggests to certified mail the documents to the defendant. Can I tact on the cost of the certified mail to what is owed to me.

You ask if you can add the cost of Certified Mailing to sums owed pursuant to a Mechanics Lien (you mention the 90-day mark, so I assume you are a subcontractor).

The Statute does not explicitly say that you can add this charge, but you may seek it in exchange for settlement of the claim, or may add it to "expenses" if you must file s uit to foreclose the lien. In that case, it will be up to the Court to decide.

Best of luck!
