Generally, if an owner or customer has an issue with the work that was done, it's a good idea to first look to the contract to see if there's any guidance on how to resolve issues regarding defects. If there isn't anything there, and if the customer refuses to repair or even acknowledge the issue, then it might be time to begin the construction defect claims process, which you can learn about in this article: Arizona Construction Defects | Jaburg Wilk. If issues continue, it could be helpful to bring in another contractor, subcontractor, inspector, etc. to inspect the work that was done and advise on whether it should be repaired or replaced. With that opinion in hand, it might be easier to argue that your contractor should return to the job to repair the work. Or, hiring a third party to come in and do that work might make sense too (after the contractor has had their appropriate opportunity to resolve the issue). Ultimately, though, I don't have personal experience in navigating Arizona defect claims. So, reaching out to a local Arizona construction attorney could help provide more insight and clarity. And, they may well have a different opinion about how to pursue a defect claim.
