IdahoMechanics Lien

We are supplying two generators to a mining company in Challis, Idaho and would like to understand if a mechanics lien is an option.

Idaho's mechanics lien statute provides lien rights to those who supply materials and equipment to mining sites. So, furnishing equipment used for mining should give rise to Idaho mechanics lien rights. To be sure, § 45-501 of Idaho's lien statute provides rights to "Every person performing labor upon, or furnishing materials to be used in the construction, alteration or repair of any mining claim..." For more information on how to preserve Idaho lien rights and how to proceed with a claim, these resources will help: (1) Idaho Mechanics Lien Guide and FAQs; and (2) How to File an Idaho Mechanics Lien – Step by Step Guide to Get You Paid. And, keep in mind that a Notice of Intent to Lien is a useful tool to get paid before a lien must be filed.
