Hi, I had my roof replaced after Irma and i had a contract w a roofer who files a NOC

My contract was that we payed the deductible and they would work w the ins co to get the rest payed and i would not owe them any more than that. They are fighting w the ins co now and im trying to close on a much needed HELOC loan and i cant now due to this lien. what can i do to get the lien off? They say if they remove it then the ins co wont pay for sure.Hoping they cld remove it so i can close the loan then they cld put it back on?? They said no. What more can be done?

You need to have your contract reviewed by an attorney. This sounds like an assignment of benefits contract and there are rules governing these contracts and what the contractor can and cannot do. It is possible the contract could give you rights vis-a-vis the contractor in this situation, but this area of the law is tricky and it is impossible to know your rights without reviewing the contract and the relevant facts. It may also be the case that the lien is invalid for other reasons. An experienced construction attorney can review your situation and advise you as to your rights.
