Filing a lien in Washington DC as a material supplier. contractor license is required to file. We are not one.

Washington DC

we are a material supplier on a Wash. DC project. GC has not paid and we need to file lien. We last supplied the project 8/17/21. One requirement in DC seems to be a contractor's license. as a materialman we would not obtain one. Does the req> reference the GC's license? If so, how do we obtain the number or copy of it. Thanks

First, I presume you supplied your materials directly to the general contractor, as sub-subcontractor's, including material suppliers to a subcontractor, do not have lien rights in DC. To answer your question concerning a business license, it depends if under DC law you are sufficiently "doing business" in the District as to require a local business license.  

Generally speaking, if you are just shipping items into the District, you would not require a local business license. If you are doing more than that, ie., you have a local yard or warehouse, a local sales office or employees located inside the District, making sales calls, etc., it is likely you do require a local business license.

Thank you for response. Yes, we shipped material the the GC. Last shipment arrived 8/17 and are sending intent to lien tomorrow with actual lien to follow on 11/6 or 7. We will send to owner &GC. Does it sound like we are within proper parameters? Perhaps we can connect tomorrow through levelset? How best to do that? Thank you
