Do I refund deposit if a customer wants to cancel contract for a patio?

I’m a general contractor. Business is in Virginia.

The short answer is that it depends on the contract. The longer answer is that there is a 3 day recission period required on residential construction. Also, if you haven't ordered anything for which the deposit money was paid, then you haven' t delivered anything to the homeowner and yes you would have to return the money, in my opinion, if you wanted to cancel the contract. All of this is general but these are the basic principals.

What if you’ve gotten all the way to the end of the project, and the customer decides they don’t like it and won’t pay for it after altering the contract many times (which there was a provision that they would pay more for materials if they did that)? Also…is it absolutely necessary to file a preliminary notice in Virginia if there is no building permit (not required for the landscaping job done). TYIA
