We were a subcontractor on a public works project for the city of McKinney TX. I filed a prelim back at the start of the project. I just spoke to someone on the phone at Levelset that confirmed the prelim had been filed and has been faxed and emailed to the GC. The order number is 8724719 I just wanted to confirm that everything is in order to be able to collect payment.
YOU must submit a sworn claim on bond not later than 45 days after the end of the month in which the work was performed.
YOU must submit a separate sworn claim on bond for each month in which work was performed and billed that was not paid.
Once you send the sworn claim on bond properly to all appropriate parties, you do not have to do anything else and you should receive correspondence from the bond company allowing or denying your claim.
YOU have 1 year to file suit on the bond claim to collect your money if not paid.
