do i have to provide customer with a list of subcontractors?

I am with a general contractors office and we finished work on a project and the customer is refusing to pay the remaining balance on their job. They are now asking for a list of the subcontractors we hired to perform work on their home. They want to ask see if they have all been paid in full. If the customer hasnt paid in full, do i have to provide this list?

It appears the homeowner wants the list because they want to be sure all subs have been paid and they want to obtain releases before releasing the funds.

This question depends on the terms of your contract. Without such a provision, there is no law that requires you to disclose all of the subcontractors. However, the homeowner should be aware of all the subcontractors through the filing of 20-day preliminary notices (those are the only subcontractors entitled to file liens). All that being said, if providing the list of subcontractors to the owner will lead to final payment, it may be worth providing the list of subcontractors.

If this is a residential remodel job then you're required to give the homeowner lien releases when they make payments to you. It's a good idea to also get lien releases from any of your subs and suppliers who sent you a preliminary notice. This will assure the homeowner that you've paid these people and that they won't lien their property.
