As long as you are within 90 days of your last work at the property, you can file a lien. It doesn't matter if there is a CO. The only issue would be if the contractor furnished a final affidavit to the owner indicating that there were no unpaid bills for labor or materials. Even if inaccurate, that could impair your lien.
