In Arizona, it is required that a preliminary “20-day” notice be sent by every person who furnishes labor, professional services, or materials to a project as a mandatory prerequisite to filing a valid mechanics lien. This requirement is strict, and the only exception is that wage laborers (employees of construction participants) are not required to provide the 20-day notice. While providing the notice within 20 days is critical to fully protect the value of the labor and/or material furnished to the project, the notice can still be partially effective if given later. A late notice is effective to protect the labor or material furnished beginning 20 days prior to the date the notice is provided. With respect to the mechanics lien itself, GCs must file a mechanics lien within 120 days from the completion of the project as a whole (or within 60 days from from when a notice of completion was filed).
