Can I file a lien

LouisianaMechanics Lien
Anonymous General Contractor

I'm a subcontractor working on a commercial project. We are providing painting services for the client in multiple townhome units. The general contractor refuses to give us a completion date of work necessary to our completion (install trim, doors, windows, etc) we notified the general contractor of our deadline for resolution and he failed to meet it. We have sent a letter of intent and now he is giving us 5 days to complete an impossible task because the materials aren't there for us to paint before he terminates the contract. Really need some help here.

If contractors and suppliers don't get paid on a construction project in Louisiana, they can file a lien to secure payment. Louisiana subcontractors are not generally required to provide notice before filing a mechanics lien, yet that preliminary notice can help reduce payment problems on a project. The deadline to file a lien in Louisiana is generally 60 days from substantial completion of the entire work. Yet, the deadline can vary depending on a few factors. Once the lien is filed in Louisiana, claimants must act to enforce the lien within 1 year of their filing. The enforcement deadline may not be extended.

In Louisiana, contractors and suppliers who do not receive payment for their contributions to a construction project generally have the right to file a mechanics lien. You can find a step-by-step guide on how to file a Louisiana mechanics lien here.
